Welcome to Salvatore's Pizzeria & Delivery! These Terms of Service ("Terms") govern your use of our website, mobile applications, and delivery services. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully before placing an order.

1. Acceptance of Terms

By accessing our website at salvatoire.org, placing an order through our online platform, or using any of our delivery services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy. If you do not agree with any part of these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Salvatore's Pizzeria & Delivery ("Salvatore's," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website. Your continued use of our services after any changes indicates your acceptance of the modified Terms.

Important: You must be at least 18 years old to place an order with Salvatore's. By using our services, you represent and warrant that you meet this age requirement.

2. Service Description

Salvatore's Pizzeria & Delivery provides authentic Italian pizza delivery services throughout Sudbury, Canada, and surrounding areas. Our services include:

  • Online Ordering: Place orders through our website or mobile application for delivery or pickup
  • Pizza Delivery: Hot, fresh pizza delivered directly to your door within our service area
  • Dine-In Services: Enjoy our pizzas at our location in New Sudbury Centre Food Court
  • Catering Services: Large orders for events, parties, and corporate functions
  • Custom Orders: Build your own pizza with our wide selection of toppings and specialty ingredients

We strive to provide the highest quality products and services, using only the finest ingredients sourced from trusted suppliers. Our menu includes traditional Italian pizzas, specialty pizzas, appetizers, salads, desserts, and beverages. All menu items, prices, and availability are subject to change without notice.

2.1 Service Area and Delivery Zones

Our delivery services are available within designated delivery zones in Sudbury and surrounding communities. Delivery availability and fees may vary based on your location. We reserve the right to refuse delivery to areas outside our service zone or to locations we deem unsafe or inaccessible for our delivery drivers.

3. Ordering and Payment

3.1 Placing Orders

Orders can be placed through our website, mobile application, or by phone. When placing an order, you must provide accurate and complete information, including:

  • Full name and contact phone number
  • Complete delivery address with apartment or unit number if applicable
  • Specific delivery instructions or special requests
  • Valid payment information
  • Any dietary restrictions or allergy information

You are responsible for ensuring that all information provided is accurate. Salvatore's is not liable for delays or failed deliveries resulting from incorrect or incomplete information. If we are unable to complete your delivery due to incorrect address information, you may be charged for the order and delivery fee.

3.2 Order Confirmation

Once your order is placed, you will receive an order confirmation via email or SMS containing your order details, estimated delivery time, and order number. Please review this confirmation carefully and contact us immediately if there are any errors or discrepancies. Your order is not confirmed until you receive this confirmation message.

We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in pricing or product information, suspected fraudulent activity, or inability to verify payment information. If your order is cancelled, we will notify you promptly and issue a full refund if payment has been processed.

3.3 Payment Methods and Processing

We accept the following payment methods:

  • Credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • Cash on delivery (subject to availability and order value limits)
  • Digital payment platforms (Apple Pay, Google Pay)
  • Gift cards and promotional codes

Payment is processed at the time of order placement for online and card payments. For cash on delivery orders, payment must be made in full to the delivery driver upon receipt of your order. We do not accept checks or money orders. All prices are listed in Canadian dollars (CAD) and include applicable taxes unless otherwise stated.

Security: We use industry-standard encryption and security measures to protect your payment information. Your credit card details are never stored on our servers and are processed through secure, PCI-compliant payment gateways.

4. Pricing and Fees

4.1 Menu Prices

All menu prices are subject to change without notice. The prices displayed on our website and mobile application at the time of order placement are the prices you will be charged. We make every effort to ensure pricing accuracy, but errors may occur. If we discover a pricing error after you have placed an order, we will contact you to inform you of the correct price and give you the option to proceed with the order at the correct price or cancel the order for a full refund.

4.2 Delivery Fees

Delivery fees vary based on your location within our service area and current demand. The delivery fee will be clearly displayed before you complete your order. Delivery fees are non-refundable except in cases where we are unable to complete the delivery due to our error or service failure.

4.3 Service Charges and Taxes

A service charge may be applied to certain orders to help cover operational costs. All applicable federal and provincial taxes, including GST and PST, will be added to your order total. Tax rates are determined by your delivery location and are calculated automatically at checkout.

4.4 Minimum Order Requirements

Minimum order values may apply for delivery orders, varying by location and time of day. The minimum order requirement, if applicable, will be displayed when you enter your delivery address. Pickup orders do not have minimum order requirements.

5. Delivery Terms and Conditions

5.1 Estimated Delivery Times

Estimated delivery times are provided at the time of order placement and are approximate only. Actual delivery times may vary due to factors including but not limited to: weather conditions, traffic, order volume, kitchen preparation time, and driver availability. While we strive to deliver within the estimated timeframe, we cannot guarantee exact delivery times.

Standard delivery times typically range from 30 to 60 minutes from order confirmation, depending on your location and current order volume. During peak hours (typically Friday and Saturday evenings), delivery times may be extended. We will notify you if we anticipate significant delays.

5.2 Delivery Procedures

Our delivery drivers will make reasonable efforts to deliver your order to the specified address. You or an authorized recipient must be available to receive the delivery. If no one is available at the delivery address, the driver will attempt to contact you using the phone number provided. If we are unable to reach you or complete the delivery after reasonable attempts, the order may be returned to our location, and you will still be charged for the order and delivery fee.

For contactless delivery requests, the driver will leave your order at your door, knock or ring the doorbell, and step back to maintain safe distance. You are responsible for retrieving your order promptly after delivery notification.

5.3 Delivery Driver Conduct and Safety

Our delivery drivers are trained professionals who represent Salvatore's. They are expected to be courteous, professional, and respectful at all times. If you experience any issues with driver conduct, please contact us immediately at 519-284-2056.

For the safety of our drivers and customers, we reserve the right to refuse delivery to locations or situations deemed unsafe, including but not limited to: aggressive behavior, intoxication, unsafe premises, or threatening conditions. Customers are expected to treat our delivery drivers with respect and courtesy.

6. Food Safety and Quality

6.1 Food Preparation Standards

Salvatore's is committed to maintaining the highest standards of food safety and quality. All our food is prepared in accordance with Canadian food safety regulations and local health department requirements. Our kitchen staff follows strict hygiene protocols, and our facilities are regularly inspected by health authorities.

We use fresh, quality ingredients and prepare each order with care. However, despite our best efforts, cross-contamination may occur in our kitchen. If you have severe food allergies or dietary restrictions, please inform us when placing your order, and we will make reasonable accommodations. However, we cannot guarantee that our products are completely free from allergens.

6.2 Allergen Information

Our menu contains items with common allergens including but not limited to: wheat, dairy, eggs, soy, nuts, and shellfish. Detailed allergen information is available upon request. It is your responsibility to inform us of any allergies or dietary restrictions when placing your order. While we take precautions to prevent cross-contamination, we cannot guarantee that any menu item is completely free from allergens.

Allergy Warning: If you have severe food allergies, please exercise caution when ordering. We recommend consulting with our staff about ingredients and preparation methods before placing your order.

6.3 Food Temperature and Handling

We deliver all food items at appropriate temperatures using insulated delivery bags and containers. Upon delivery, please check that your food is at the expected temperature. If your food arrives cold or at an inappropriate temperature, please contact us immediately so we can address the issue.

Once delivered, it is your responsibility to handle and store the food properly. We recommend consuming delivered food within two hours of delivery. Salvatore's is not responsible for food safety issues arising from improper storage or handling after delivery.

7. Cancellations and Refunds

7.1 Order Cancellation Policy

You may cancel your order within 5 minutes of order placement by contacting us immediately at 519-284-2056. Once your order has entered preparation (typically within 5-10 minutes of order confirmation), it cannot be cancelled, and you will be charged the full order amount.

If you need to modify your order, please contact us as soon as possible. We will make reasonable efforts to accommodate changes, but we cannot guarantee modifications once preparation has begun.

7.2 Refund Policy

We stand behind the quality of our products and services. If you are not satisfied with your order, please contact us within 24 hours of delivery. Refunds or credits may be issued at our discretion in the following circumstances:

  • Incorrect order delivered (wrong items or missing items)
  • Food quality issues (cold food, burnt pizza, incorrect preparation)
  • Significant delivery delays caused by our error
  • Order cancellation before preparation begins
  • Failure to deliver order due to our error

Refunds are typically processed within 5-10 business days to the original payment method. In some cases, we may offer store credit or a replacement order instead of a monetary refund. Delivery fees are non-refundable except in cases where we fail to deliver your order due to our error.

7.3 Disputes and Complaints

Please provide your order number, date of order, and detailed description of the issue. We will investigate your complaint and respond within 48 hours. If we are unable to resolve your complaint to your satisfaction, you may pursue resolution through applicable consumer protection agencies or small claims court.


8. Intellectual Property Rights

All content on our website, mobile applications, and marketing materials, including but not limited to text, graphics, logos, images, recipes, menu descriptions, and software, is the property of Salvatore's Pizzeria & Delivery or our licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from our website or applications without our express written permission. The Salvatore's name, logo, and all related marks are trademarks of Salvatore's Pizzeria & Delivery. Unauthorized use of our trademarks is strictly prohibited.

8.1 User-Generated Content

If you submit reviews, comments, photos, or other content to our website or social media channels, you grant Salvatore's a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content for marketing and promotional purposes. You represent that you own or have the necessary rights to any content you submit and that such content does not violate any third-party rights or applicable laws.

9. Privacy and Data Protection

Your privacy is important to us. We collect, use, and protect your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our collection and use of your personal information as described in our Privacy Policy.

We collect information necessary to process your orders, including your name, contact information, delivery address, and payment details. This information is used solely for order fulfillment, customer service, and improving our services. We do not sell or share your personal information with third parties except as necessary to process your orders or as required by law.

9.1 Account Security

If you create an account on our website or mobile application, you are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. Salvatore's is not liable for any loss or damage arising from your failure to protect your account information.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Salvatore's Pizzeria & Delivery, its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from or related to these Terms or our services shall not exceed the amount you paid for the specific order giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10.1 Force Majeure

Salvatore's shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, severe weather, power outages, labor disputes, government actions, pandemics, or other emergencies. In such events, we will make reasonable efforts to notify affected customers and fulfill orders as soon as possible.

11. Indemnification

You agree to indemnify, defend, and hold harmless Salvatore's Pizzeria & Delivery, its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

  • Your violation of these Terms of Service
  • Your violation of any applicable laws or regulations
  • Your violation of any third-party rights
  • Your misuse of our services or website
  • Any content you submit or post through our services

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from or related to these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in Sudbury, Ontario.

12.1 Arbitration Agreement

For disputes involving amounts less than $5,000 CAD, you agree to first attempt to resolve the dispute through good faith negotiations with Salvatore's. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration in accordance with the Arbitration Act of Ontario. The arbitration shall be conducted in Sudbury, Ontario, and the decision of the arbitrator shall be final and binding.

13. Modifications to Terms

Salvatore's reserves the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated Terms on our website with a new "Effective Date" at the top of the document. For significant changes, we may also provide notice via email or through our website or mobile application.

Your continued use of our services after any modifications to these Terms constitutes your acceptance of the modified Terms. If you do not agree with the modified Terms, you must discontinue use of our services. We recommend reviewing these Terms periodically to stay informed of any updates.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Salvatore's Pizzeria & Delivery regarding your use of our services and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral.

16. Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. Salvatore's may assign or transfer these Terms or any rights or obligations hereunder at any time without notice or consent. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
